Something about the disposal of hazardous waste

The Association is approached by individual crushed stone enterprises that are currently faced with the problem of concluding a contract with a licensed specialized enterprise regarding the disposal of waste generated at the enterprise during its economic activities.

The list of such waste includes, in particular, spent fluorescent lamps, batteries, various oils and greases, greased rags, rubber products, etc.

The Law of Ukraine dated June 20, 2022 No. 2320-IX “On Waste Management”, which, according to Clause 1 of Chapter XI “Final and Transitional Provisions”, was supposed to enter into force 12 months after its publication, was published in the “Voice of Ukraine” newspaper dated July 9, 2022 No. 141 and, accordingly, entered into force on July 9, 2023.

In accordance with Clause 141 of the first part of Article 7, the first paragraph of the second part of Article 9 of the Law of Ukraine “On Licensing of Types of Economic Activities”, the first part of Article 44 of the Law of Ukraine “On Waste Management”, the Cabinet of Ministers of Ukraine by Resolution No. 1278 of December 5, 2023 approved the Licensing conditions for the conduct of economic activity on hazardous waste management and at the same time recognized as having lost the validity of the Resolution of the Cabinet of Ministers of Ukraine dated July 13, 2016 No. 446 “On approval of the licensing conditions for conducting economic activity on the management of hazardous waste”.

Resolution No. 1278 of the Cabinet of Ministers of Ukraine of December 5, 2023 entered into force in its entirety only on January 9, 2024.

Thus, from January 9, 2024, when the Resolution of the Cabinet of Ministers of Ukraine dated July 13, 2016 No. 446 “On Approval of Licensing Conditions for Conducting Business Activities for the Management of Hazardous Waste” expired and the Resolution of the Cabinet of Ministers of Ukraine dated 5 of December 2023 No. 1278 “On Approval of Licensing Conditions for Conducting Hazardous Waste Management Business Activities”, and until today, quite a bit of time has passed for interested business entities to fully prepare the necessary documents for obtaining a license necessary for conducting business management activities hazardous waste.
