The Association Requested Clarification from the State Regulatory Service of Ukraine

The issue of increasing weight limits for the transportation of non-metallic construction materials on local public roads was covered in detail in the News section on 13 May, 1 June, and 6 July of this year.

Given that the latest response from the Ministry for Communities and Territories Development of Ukraine (now the Ministry for Restoration, Infrastructure and Transport of Ukraine), referring to the Law of Ukraine “On the Legal Regime of Martial Law”, contradicted the provisions of the Law of Ukraine “On the Principles of State Regulatory Policy in the Sphere of Economic Activity”, the Association submitted a request to the State Regulatory Service of Ukraine seeking clarification on the legality of the Ministry’s actions.

Specifically, the Association requested clarification as to whether it was lawful for the Ministry not to include the draft Resolution of the Cabinet of Ministers of Ukraine “On the Implementation of the Pilot Project for Financing Current Repairs and Operational Maintenance of Public Roads by Business Entities” in the Ministry’s 2026 Plan for the Preparation of Draft Regulatory Acts, not to publish the draft on its official website, and not to submit it to the State Regulatory Service of Ukraine for review.
