The Cabinet of Ministers Approved the Draft of the New Customs Code

On 28 May 2026, the Cabinet of Ministers of Ukraine approved the draft of the new Customs Code of Ukraine, which is intended to align Ukrainian customs legislation with European Union (EU) standards and constitutes one of the key elements of the negotiation process for Ukraine’s accession to the EU.

According to the Minister of Finance of Ukraine, S.M. Marchenko, most provisions of the new Code will be clear and understandable for both businesses and customs authorities, as Ukraine’s regulatory framework has long been adapting to EU rules.

Overall, the draft of the new Customs Code consists of 781 articles and is structured in accordance with the EU customs legislation framework.

The document provides for:

• a full transition to EU customs terminology;

• the introduction of an authorisation system;

• new approaches to customs procedures and declarations;

• European rules regarding customs debt, guarantees, and duty exemptions;

• new mechanisms for adopting customs decisions.

To ensure business continuity, the draft provides that indefinite authorisations will remain valid, while fixed-term authorisations will remain effective until the expiration of their term or completion of the relevant operations.

The next stage will be the submission of the draft law to the Verkhovna Rada of Ukraine.
