Emergency services for mining companies

One of the issues that the Association has been concerned with recently has been the issue of improving the current legislation on emergency rescue services for mining companies.

The position of the State Emergency Service of Ukraine (SES) on this issue is clear: ‘The SES sees no reason to develop amendments to the legislation on the permanent and mandatory emergency rescue services for mining companies’ (for an example, see the Association’s Newsletter of 19 December 2022).

Considering that the current legislation of Ukraine does not provide for a clear definition of the sources of funding for emergency services, the Association appealed to the Verkhovna Rada Committee on Environmental Policy and Nature Management, which is responsible for environmental safety, prevention and elimination of the consequences of natural disasters, man-made accidents and catastrophes, and the activities of state emergency services, with a request to develop a draft law amending Article 29 of the Mining Law of Ukraine in terms of funding for state

The Parliamentary Committee on Environmental Policy and Nature Management did not want to resolve this issue, but simply forwarded it to the State Emergency Service of Ukraine, which in its letter did not even mention the imperfection of the current legislation on the financing of emergency services, but once again demonstrated the inviolability of its position, set out in December 2022, stating that ‘the issue of emergency services for mining enterprises and determining its cost is regulated by law.
