{"id":2100,"date":"2024-08-19T12:08:05","date_gmt":"2024-08-19T09:08:05","guid":{"rendered":"https:\/\/avnbmu.com.ua\/?p=2100"},"modified":"2024-09-05T12:36:31","modified_gmt":"2024-09-05T09:36:31","slug":"review-of-court-practice-on-the-protection-of-subsoil-use-rights-in-ukraine","status":"publish","type":"post","link":"https:\/\/www.avnbmu.com.ua\/en\/news\/review-of-court-practice-on-the-protection-of-subsoil-use-rights-in-ukraine\/","title":{"rendered":"On the review of court practice on the protection of subsoil use rights in Ukraine"},"content":{"rendered":"\n<p>The Supreme Court of Ukraine has published a review of the court practice of the Administrative Court of Cassation in cases concerning the protection of the right to use subsoil in Ukraine.<\/p>\n\n\n\n<p>The review covers the established court practice formed in the resolutions of the Supreme Court from 2019 to June 2024 and contains legal positions, in particular, on:<\/p>\n\n\n\n<ul>\n<li>&#8211; distribution of powers of village and district councils to provide subsoil of district and local significance for use<\/li>\n<\/ul>\n\n\n\n<ul>\n<li>&#8211; the obligation of the authorised bodies to make a decision based on the results of consideration of the subsoil user&#8217;s application;<\/li>\n<\/ul>\n\n\n\n<ul>\n<li>&#8211; grounds for granting a special permit for subsoil use without an auction;<\/li>\n<\/ul>\n\n\n\n<ul>\n<li>&#8211; conditions for applying the principle of \u2018tacit consent\u2019 when extending the term of a special permit for subsoil use;<\/li>\n<\/ul>\n\n\n\n<ul>\n<li>&#8211; the obligation of subsoil users to obtain a special permit for subsoil use in case of discovery of data on new properties, quality or quantity of minerals;<\/li>\n<\/ul>\n\n\n\n<ul>\n<li>&#8211; determining the amount of the fee for the extension of special permits for subsoil use;<\/li>\n<\/ul>\n\n\n\n<ul>\n<li>&#8211; restrictions for subsoil users in the use or disposal of extracted minerals;<\/li>\n<\/ul>\n\n\n\n<ul>\n<li>&#8211; requirements to the decision of the authority to refuse to approve subsoil use;<\/li>\n<\/ul>\n\n\n\n<ul>\n<li>&#8211; determination of entities authorised to exercise state control over geological exploration of subsoil and its rational and efficient use;<\/li>\n<\/ul>\n\n\n\n<ul>\n<li>&#8211; conditions under which the subsoil user is not required to submit statistical reports during the inspection by the supervisory authority;<\/li>\n<\/ul>\n\n\n\n<ul>\n<li>&#8211; grounds for termination of the right to use subsoil;<\/li>\n<\/ul>\n\n\n\n<ul>\n<li>&#8211; termination of the right to use subsoil if the subsoil user fails to eliminate the violations that led to the suspension of the special permit;<\/li>\n<\/ul>\n\n\n\n<ul>\n<li>&#8211; calculation of the time limit for filing a lawsuit in case of refusal of the authorised representative of the company where the inspection was carried out to receive the inspection report and the order, etc.<\/li>\n<\/ul>\n\n\n\n<p>For more details, please follow the link: <a href=\"https:\/\/supreme.court.gov.ua\/userfiles\/media\/new_folder_for_uploads\/supreme\/sud_pract\/Oglyad_KAS_korist_nadra.pdf\" target=\"_blank\" rel=\"noopener\" title=\"\">Review of the Court Practice of the Administrative Court of Cassation within the Supreme Court in Cases Concerning the Protection of the Right to Use Subsoil in Ukraine<\/a><\/p>\n","protected":false},"excerpt":{"rendered":"<p>The Supreme Court of Ukraine has published a review of the court practice of the Administrative Court of Cassation in cases concerning the protection of the right to use subsoil in Ukraine.
